Casamigos and Don Julio Sued for ‘100% Agave’ Claims

A class action lawsuit has been filed in the U.S. District Court for the Eastern District of New York against Diageo, alleging that the company has misled consumers by labeling its Casamigos and Don Julio tequilas as “100% agave.”

The proposed lawsuit contends that neither brand qualifies to bear the “100% agave” label in Mexico and the United States, despite this claim appearing on their packaging. This is important because, according to Mexican law, only tequilas made exclusively from Blue Weber agave sourced from specific regions in Mexico can be labeled as “100% agave.”

The lawsuit seeks $5 million in damages for consumers and requests an injunction to stop Diageo from continuing its allegedly deceptive advertising practices. In response, Sophie Kelly, Diageo’s global head of agave, described these claims of adulteration as outrageous and categorically false.

Diageo firmly rejects these allegations, maintaining that its tequilas comply with all regulatory standards and have been certified by both the CRT and U.S. authorities.
