Ex-Dallas Police Officer Sues Detective After Being Wrongly Arrested For Capital Murder

On Thursday, an ex-Dallas police officer filed a lawsuit against a Dallas homicide investigator. The former officer says that the investigator wrongfully arranged his arrest for capital murder last year. He had been jailed for over a month.

Last April, charges were dismissed against Bryan Riser. This came after a judge said that he discovered no evidence that would justify holding him.

As of now, Detective Esteban Montenegro is on administrative leave. He is under criminal investigation after being accused of perjuring himself and tampering with documents.

Paperwork filed in court detailed Riser’s arrest. It said the arrest was “based entirely on the uncorroborated statements of a person directly linked to five murders.” Most of the case relied on statements made by Emmanuel Kilpatrick, a convicted murderer.

It was reported that the district attorney’s office had told Montenegro that there wasn’t enough evidence to arrest Riser.

“…nonetheless, Montenegro went ahead with the arrest that had already been told was unsupported by probable cause.”

The lawsuit also details other issues with the case. One was that the initial arrest warrant falsely said that cell tower records put Riser and his patrol vehicle in the area of the killings when they happened.

In March 2021, Dallas Police Chief Eddie Garcia had stated that Riser had been arrested after detectives had gathered evidence against him. He said that it showed Riser paid to have two people killed in 2017. A few days after that, Riser was terminated.

Riser has appealed his firing.
