Joseph Sobolewski, from Pennsylvania, was apprehended last month and faces felony charges. He saw that a store had a sale for two Mountain Dews for $3.

He obtained just one bottle and placed $2 on the counter and left the store. The employees called the authorities, and he was placed in custody.

Sobolewski might not have been aware that the soda costs $2.29 not $1.50.

He now has a $50,000 bond and could spend 7 years in prison because of the three strike rule. He is homeless and has already been convicted of many minor offenses.

The first offense happened more than 10 years ago when he stole gas. Then, in 2011, he was in trouble for stealing a pair of $39.99 shoes from K-Mart. He had to pay more that $866 and spend 3 months locked up for that.

Two months before the current incident, him and his wife allegedly stole arts & crafts from a Hobby Lobby.
