Plano Man Sentenced to Life After Fatally Punching Fellow Customer Buying Pizza

A Plano man has been sentenced to life in prison for fatally punching a man who was purchasing a pizza at the same time as him.

James Gutierrez, 38, was convicted on aggravated assault causing serious bodily injury for the July 31, 2020 killing.

Gutierrez and his fiancé went to a Little Caesars in Plano and purchased a pizza for dinner. After ordering their pizza, the couple went back to their vehicle and waited for the pizza to be ready.

While waiting for his food, Gutierrez sees another customer exiting the store and calls him over. The victim, who was buying dinner after work, placed his pizza on his truck and started walking towards Gutierrez.

At this time, Gutierrez approached the man and delivered a punch with a closed fist, killing the man.

Witnesses say there was no interaction between the victim and Gutierrez before the fatal punch.

The life sentence came down on Gutierrez after jurors learned that he has gang affiliation and a lengthy criminal background which includes sexual offenses. He is also accused of assaulting his fiancé while he was out on bond awaiting trial.
