Allen Russell, 38, is currently serving a life sentence for being found guilty of having more than 30 grams of marijuana in Mississippi.
Russell was denied an appeal due to his history of being an “habitual offender”. He was given life without parole in 2019 once he was convicted.
He was previously convicted of two separate home burglary charges in 2004 and possession of firearm in 2015.
The Mississippi Clarion-Ledger reported in 2020 that there were 86 “habitual offenders” serving life without parole because they were convicted of non-violence crimes just like Russell.
