
Starting September 1, Texas businesses will be restricted from selling or promoting vapes that contain cannabinoids like THC or nicotine.
Signed into law by Governor Abbott, Senate Bill 2024 prohibits the sale of THC-containing e-cigarettes and hemp-derived products such as Delta-8. The law also limits what nicotine vapes can be sold—excluding those made in China, marketed to minors, or made to look like toys or phone cases. Offenders may face up to a year in jail and fines up to $4,000.
While the sale of disposable THC vapes is banned, products such as batteries without THC and THC-infused edibles like gummies will still be legal.
Furthermore, the Texas Senate has approved Senate Bill 6, which aims to nearly eliminate all THC products in Texas. The bill is now in the House, but it remains uncertain whether Governor Abbott will veto it again.
