Woman Files Lawsuit Against Hershey For $5 Million After Reese’s Pumpkins Didn’t Have Faces
Cynthia Kelly, of Tampa, Florida, has filed a lawsuit against The Hershey Company, alleging that they “tricked” customers with false advertisement on Reese’s seasonal-shaped chocolates.
Kelly is suing the company for $5 million, noting that the packaging and what is really inside aren’t the same.
For instance, the pumpkin-shaped chocolate doesn’t contain eyes and nose cutouts like the packaging displays. Additionally, the football shape is similar to an egg, the lawsuit says.
The strange lawsuit came about when Kelly bought pumpkin-shaped candies from Aldi for $4.49. She had thought that it had a unique looking carved, pumpkin-mouth and eyes as shown on the items’ packaging.
Kelly said that she would have never purchased the candies had she known that the carved faces weren’t actually on the candies.
The lawsuit contains more than just the pumpkin-shapes. It also names the ghosts, bats, footballs, snowmen, and bell-shaped candies, many of which were pictured in the suit’s documents.
Kelly also noted that Reese’s packaging use to show what was actually inside about 2 to 3 years ago as no faces had been shown.
She also referenced several YouTube videos, where creators had also said that Reese’s had been deceptive and didn’t “deliver.”
The class action lawsuit will include all who purchased these specific candies in the state of Florida.
