A Denton County HOA is Prohibiting Homeowners From Renting to Section 8 Tenants

Providence Village Home Owners Association in Denton County put in place a rule that bans homeowners from renting to Section 8 tenants.

The new restrictions have forced landlords to evict any tenants that get government-subsidized rental assistance, otherwise known as Section 8. In addition to this rule, landlords are also not allowed to own more than one home in the HOA.

The Providence Village HOA, which has 2,000 homes in the neighborhood, has given homeowners 30 days to evict any Section 8 tenants. After the 30 days, they will be fined $300 a week for still having those renters.

Many homeowners are frustrated and say they are stuck in a horrible situation. One of the rules for landlords working with the rental assistance program is they must offer their renters 90 days to relocate.

Landlords that have built relationships with the families believe it is unfair and discriminatory. They acknowledge that their tenants will be forced to relocate to other Section 8 approved housing, which could take weeks, if not months.

Real Estate Investor Judy Rooker has 10 homes in the neighborhood she rents out. Her real estate team is working with attorneys to see if the HOA has violated anyone’s rights. She wants to fight for not only her rights as a business owner, but for the rights of her tenants as well.

Judy Rooker owns more than 50 properties in the DFW and says this is the first time she is being forced to tell good tenants they have to leave.

  1. Please take the time to communicate with both non-section 8 renters and the HOA. Unfortunately, this situation has been framed as a race issue but really it’s about an increase in crime related to increases in lower socio-economic population. The HOA was given the authority by homeowners to make rules to protect the neighborhood. Again, POV has historically been crime free and very kid friendly. The last year has seen an increase in crime, gun related incidences, altercations, etc. POV has also experienced a decrease in utilization of many neighborhood amenties which make the community a sort after location in DFW.

    Although race is depicted in the article and being pushed by some section 8 renters, the true intent of the HOA is the protection and restoration of a peaceful community.

    1. Lol non renter although it isn’t about race some of the homeowners have made it about race saying rude racist things about the people of color. People of color walking to the park and they’re immediately supposed to be on section 8. The children can’t even come outside and play anymore because they’re automatically committing a crime. No one knows where the crime is but it’s being blamed on section 8 renters. It’s sad and it’s disgusting to watch people criticize and ridicule the next just because they have to obtain government assistance to pay for them to have a roof over their heads. I’m not on section 8 but I’m disappointed in my neighbors for treating people the way they have been treated. Showing up to peoples houses to tell them about themselves for needing assistance. (Skeetersaysfack) whatever his name maybe, he’s the biggest racist prick of them all. He has some help but he’s the worst of them all. Bothering their jobs/self employed ways of making money. It’s sad! These people should be ashamed of themselves.

      2. As a black man, I agreed with you regarding the increase in racial profiling. I rarely walk out streets without the occasional stares. My kids also experience this. This is inherently a racist neighborhood. This has to stop. Regarding the new rules, we as homeowners have the right to place restrictions in place to maintain the neighborhood as a high income community. I disagree with classifying of section 8 or minority residents as the cause of increase crime without true evidence (not facebook posts). We are in a time where everyone feels they are in the right and they can say whatever they like. Unfortunately, politics of the last few years have increased the boldness of the racist extremists to become more emboldened and advert. Our neighborhood is the perfect example of the fight our country is experiencing between good vs evil hearted people. We must do better.

Creating inflated rental prices that Deny other families that would like to rent in communities.section 8 Rentals going for $3500.00 per month when it should be around $2000.00 or lower.

  3. Try taking the time to actually investigate and not just post crap. This is a garbage one sided article aimed to slander a neighborhood. If you cant afford to live in our neighborhood then you can find one that you can. Life isn’t fair and your reporting follows right along with it. Why aren’t you reporting on the 2 shootings in the neighborhood the recent robbery suspects the basketball court stabbing. Once again get it together and do something that is aimed to better a community as a whole because section 8 government funded crap is one of the biggest issues this country has and POV has had enough. POV is doing everything it can to get back to the quiet neighborhood where people want to move to and raise their children!

What these people forget to inform everyone is since the surge of section 8 tenants have moved into the providence village area that about 90 percent of the major felony crimes have been section 8 households. An we know this by the address that is posted when they are booked for attempted murder, firing a gun in or near a dwelling, drug possession with intent to distribute. Alot of the people on section 8 are also committing fraud becuase magically they own multiple small business but haven’t made a profit in 5 years to get off section 8. The town had blocked them from staying because it is going to make the community a. Better place and not allow the town to turn into fucking the shithole like garland and oak cliff. Over runned ghettos that destroy a community.

    Providence Village residents won’t allow it to happen to are beautiful community.

  5. Your article is incorrect on a few different points. Did you interview anyone from the HOA? Did you read the new rules? Did you ask Rooker what she is charging for rent ? Does she charge fair market value or is she gouging the government and running up rental prices for everyone else? Does she LIVE in our community? Higher crime pulls all of our property value down including those of the investor. The $300 weekly fine is to the owner, not the tenant. The owner can still choose to carry out the lease, they are just going to pay the fines out of their profit.

Wow…seeing the replies from residents of this housing development telling people to find other neighborhoods they can afford to live in and that this misguided action is not racists when the data shows that 66% of HUD users belong to racial minorities and 45% of HUD-assisted individuals are black.

    1. lol….here’s the deal…when people make a certain income, and can afford to live where they want to stay away from the dregs of society, it sucks to have the dregs of society imported by Section 8 handouts. People need to live where they can afford to live. Rental properties and Section 8 are a cancer upon every neighborhood.

  7. By stating that this is a racial vote you are assuming that people of color do not own homes here and did not vote for this. I am telling you to you are wrong. I saw them cast their vote with my own eyes. I have neighbors that own a home near mine that are Hispanic and African American that own their home and have never given any issues and the police has never been to their home. We can see the address of every person that gets arrested in this neighborhood we can see who is on section 8. The neighbors look it up and the instigators don’t and look the other way.
    This community has taken in homeless people, if you don’t remember that then you didn’t live here yet. Turns out they were faking and scammed the neighbors. This community gave a car to someone whose car cought on fire. This community donated money to several house fires neighbors had.
    So when people try to paint this community as evil heartless. My husband and I started from nothing and worked our way up into owning a home. Who would have thought that a high school drop out could own a home. We lived in bad areas and we were on government assistance when we were young. We are not rich we still can’t afford health care but we work hard and pay our bills and don’t want this criminal activity to continue where we live. It was not like this when we first moved here, crime started happening when vouchers started being accepted. I hate to say this but it is true and even the police officer at the meeting said crime has been increasing.
